Terms of service

Draft 0.1 · Oct 9, 2026 · not yet in force

1Who you are agreeing with§

These terms are between you (or the organization you sign up for) and [SMMist operating entity, to be confirmed] (“SMMist”, “we”). By creating a workspace or using an API key you accept them. If you accept for an organization, you confirm you can bind it.

2The service§

SMMist is an API, an MCP server and a dashboard for drafting, validating, approving, scheduling and publishing posts to third-party social networks, and for keeping an audit record of those steps. SMMist does not write your posts. Text and media come from you or from software you run, including AI agents.

3You are responsible for what is published§

Everything published through your workspace is published by you, whether a person or an agent prepared it. You decide which keys may publish and which posts require approval (scopes and approval_mode). You are responsible for:

  • the content of every post and its compliance with law and the networks’ rules;
  • the agents and integrations you connect, and every action taken with your API keys;
  • keeping keys secret, and revoking any key you believe is exposed;
  • having the rights to the accounts you connect and the media you upload.

4X (formerly Twitter): your developer agreement passes through§

SMMist does not resell or sublicense access to the X API. To post to X you connect a developer app that you own, under your own agreement with X Corp. By connecting it you confirm, and agree, that:

  • you hold an X developer account and have accepted X’s Developer Agreement and Developer Policy, and you remain bound by them for everything SMMist does with your app’s credentials;
  • SMMist acts only as your service provider, calling the X API on your behalf with your credentials, within your app’s permissions and rate limits;
  • X bills you directly for your API usage; those fees are not part of your SMMist plan;
  • you will not use SMMist to break X’s rules, including its rules on automation, spam, duplicate content and platform manipulation;
  • if X restricts or revokes your app, or tells us your use breaches its terms, we may stop sending to X for your workspace without notice.

Nothing in these terms grants you rights in X content or the X API beyond what X grants you.

5Instagram and Meta§

Instagram publishing runs on SMMist’s own Meta app. When you connect an Instagram professional account you also agree to Meta’s Terms of Service, the Instagram Terms of Use and Community Guidelines, and you authorize us to publish to that account on your instruction. You can remove SMMist from your Instagram settings at any time; see Data deletion. If Meta revokes our access or an account’s token, posts to that account will fail with needs_reconnect until it is reconnected.

6Acceptable use§

You will not use SMMist to:

  • publish unlawful, deceptive, harassing or infringing content, or content that impersonates a person or organization;
  • run spam, coordinated inauthentic behavior, or evade a network’s limits or enforcement;
  • probe, overload or attack the service, or other customers’ data;
  • publish political or financial promotions without the disclosures the law requires.

7The audit record§

SMMist records each step of a post’s life in an append-only, hash-chained log and lets you verify it. The record shows what the service observed and did. It is evidence you can use; it is not legal advice, and it does not by itself make your use compliant with any regulation. The Compliance plan’s supervision features will be governed by an order form.

8Timing and availability§

Scheduled times are targets, not promises. Networks can be slow, rate-limit you or reject a post. A target that has not published by its not_after time fails rather than posting late. Unless a written agreement says otherwise, the service is provided without an uptime commitment, and we may change or retire features with notice on the changelog.

9Plans and fees§

Plans and prices are on the pricing page. Paid plans are billed monthly in advance, exclude tax, and meter published post-targets beyond the allowance. You can cancel at any time; the plan runs to the end of the period. Fees already paid are not refunded except where the law requires.

10Suspension and termination§

We may suspend a workspace that breaches section 4, 5 or 6, or that puts the service or others at risk, and will tell you why unless the law forbids it. After a workspace closes, your audit export stays downloadable for 90 days; then the workspace’s data is deleted as described in the privacy policy.

11Disclaimers and liability§

The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential loss, for the acts of the networks, or for content you or your agents publish, and our total liability is capped at [the fees you paid in the twelve months before the claim].

12Changes and contact§

We will post changes here and, for material ones, email workspace owners before they take effect. Governing law: [to be confirmed]. Questions: hello@smmist.com.
